EEC Board Decision No. 31 of 10 March 2026 enters into force on 28 October 2026. It sets transitional rules for cosmetics affected by amendments under EEC Council Decision No. 74 of 12 September 2025. These transitional rules have not yet taken effect as of this article’s publication date.
Existing documents
Decision No. 31 allows declarations adopted before 28 October 2026 and SGRs issued before that date to remain valid until their expiry. This applies to the products covered by the decision; it does not automatically extend every document.
There is an exception for SGRs: this provision does not cover the documents referred to in paragraph 1(b) of EEC Board Decision No. 24 of 4 March 2025. The issue date and applicable transitional regime must therefore be checked together.
Manufacture and circulation
With the relevant documents, manufacture and placing products on the market are permitted until those documents expire. Products placed on the market during that period may remain in circulation for the shelf life specified by the manufacturer.
How to prepare
- List current declarations and SGRs with their issue and expiry dates.
- Check whether the specific product is affected by Decision No. 74.
- Align production and shipment plans with document validity.
- For new applications, agree on current dossier and testing requirements in advance.
